LITTLE ROCK (AP) — The Arkansas State Police are declining a request by Little Rock police to investigate a deadly shooting by a Little Rock officer.

Little Rock Police Chief Stuart Thomas asked the state police on Tuesday to investigate the Dec. 9 shooting of 67-year-old Eugene Ellison by officer Donna Lesher. But state police spokesman Bill Sadler says the state police isn't comfortable taking over an investigation that's already a week old.

Sadler told the Arkansas Democrat-Gazette that an investigation may not be fair because state police were not involved from the start.

Police have said Lesher shot Ellison at his apartment after he attacked Lesher and detective Tabitha McCrillis. Lesher and McCrillis were working as security guards at the apartment complex and said they were checking on Ellison after finding his door open.
