HOPE (AP) A prosecutor has concluded that three law enforcement officers were justified in fatally shooting a suspect who had just wounded an Arkansas state trooper at a home near Hope.
Fred Moore, 43, of Hempstead County, shot state police Special Agent Scott Clark in the right arm and shoulder with a handgun on March 12. Clark, Hempstead County Sheriff's Lt. Frankie McJunkins and state police Sgt. John Bishop returned fire, killing Moore.
Prosecutor Chris Thomason said the officers were in danger and had to use their weapons.
"Based on my observations at the scene and a complete review of the investigation of the incident, I have determined that the officers were in imminent danger of death or serious physical injury because of the actions of Mr. Moore," Thomason said.
Thomason explained his findings in a March 31 letter to state police Sgt. Ron Stayton of the troop in Pine Bluff.
"The shooting of Special Agent Scott Clark reinforces my belief that the officers acted in a swift, decisive and professional manner under extreme and life-threatening circumstances," Thomason wrote.
Clark, McJunkins and Bishop were investigating the murder of Donald K. McGee, 56, of Hempstead County.
