A Perry County couple has filed a lawsuit against Conway’s Crain Buick GMC dealership.
Byron and Allyson Ponder filed the federal lawsuit with the U.S. District Court Eastern District of Arkansas Western Division after the dealership allegedly falsified information on a truck they purchased.
The couple claims they were told a 2014 GMC Acadia that was on loan to the University of Central Arkansas had 33,534 miles on it. The Ponders purchased the vehicle on April 6, having not inspected it themselves. When they picked it up the next day, they said they noticed the odometer reading was "substantially in excess" from what they were told.
The odometer showed the vehicle had 39,900 miles on it and not 33,534, the couple stated.
The Ponders said they filed the lawsuit against Crain Buick GMC for deceit and for violating the federal odometer, Arkansas odometer and Magnusson-Moss warranty acts among other reasons.
The couple agreed to buy the truck for $27,770, with more than $3,000 credited toward the purchase from their 2008 Toyota trade in.
Because information was falsified, the couple said it was seeking relief and to terminate its contract with finance company Enterprise Financial Group.
A trial had not yet been set by press time Friday.
