Faulkner County Sheriff's Office investigators arrested a 40-year-old Level 3 sex offender in Conway on multiple felony charges Friday following a compliance check.

Spokesman Adam Bledsoe said that pursuant to Arkansas law, the sheriff's office regularly conducts these checks to ensure all registered sex offenders in the area are in compliance with registration requirements.

"We are required by law to do compliance checks and we take that responsibility very seriously," he said. "We will always do our best to make sure that all sex offenders we are responsible for are in compliance ... that's a service we need to provide the citizens of Faulkner County and will do always."

Michael Wayne Smith was registered at 23 Tupelo Rd. in Conway. However, while conducting the compliance check Friday, investigators learned that Smith never lived at that address and could be found at 497 Acklin Gap Rd.

Living at the Acklin Gap residence was a violation of registered sex offender requirements because it is located approximately 918 feet from the Cold Springs Youth Church Camp Retreat, Bledsoe said.

Arkansas law makes it unlawful for Level 3 and 4 sex offenders to reside within 2,000 feet of a public, private or secondary school or daycare facility, according to Arkansas Code § 5-12-128. Act 818 further prohibits sex offenders from living within 2,000 feet of public parks and youth centers.

Bledsoe said Smith was also in violation of Arkansas Code § 12-12-903, which requires registered sex offenders to report in person any changes in residence, mailing address, temporary domicile, employment, email and social network information to law enforcement.

"Also during the investigation it was found that Smith had changed employment without reporting the change for over a month," he said in a release Monday. "Smith first registered with the Faulkner County Sheriff's Office on January 5, 2017, and has never had the permanent physical address changed on his driver's license."

Providing false information to obtain an ID or driver's license with an incorrect permanent physical address is a Class D felony.

Following the compliance check, Bledsoe said Smith now faces three felonies: failure to comply with registration and reporting requirements as a sex offender, registered sex offender living near a school, public park, youth center or daycare; and registered offender providing incorrect permanent physical address on identification cards or driver's license.

Bledsoe said the sheriff's office encourages residents to report if they have suspicions on whether a sex offender is complying with registration requirements.

"If anyone knows of a sex offender that is not in compliance, they are encouraged to report it to [Investigator] Vanda Phillips at 501-450-4917 or leave an anonymous tip at www.fcso.ar.gov and click on the 'Crime Tips' tab," he said.

As of press time Monday, a court date had not yet been set in Smith's case.
