Violation of omnibus DWI act - first offense, Marble Slab Creamery, 605 Salem Road.
Officers responded to the area when employees at the business called to report a woman that they believed to be impaired, who was driving erratically. The employees stated that they watched the woman as she was driving away and saw her almost hit two cars in the parking lot before driving over the curb to get to the street. They provided the officers with a description of the suspect’s vehicle and officers searched the area and found the vehicle sitting in the drive through at McDonald’s. When they approached the vehicle, they observed the suspect slumped over to the left, in the driver’s seat of the vehicle. They knocked on the window of the vehicle and tried to open the door but it was locked. The suspect woke up, looked at the officers and looked around her vehicle, adjusted her sunglasses and drove forward going up over a curb, some shrubs, flowers and hit a rock fountain in the garden area. The officers hit the side of the suspect’s vehicle demanding that she stop the vehicle, the suspect instead placed the vehicle in reverse and started backing out of the garden. With one wheel still on the curb, the suspect opened her door and the officer’s noted that when they asked her what was going on, she asked, "Where am I?" The woman told officers that she had not been drinking and could not understand how the situation was happening. She did admit to taking half of a Xanax pill inside her vehicle, but after being questioned by the officers and treated by the Conway Fire Department as well as MEMS, she was given standardized field sobriety tests, which she failed. She finally admitted to taking two milligrams of Xanax and several painkillers. She was arrested and transported to the Faulkner County Detention Center for processing.
